Federal Court Mandates Freedom of Abrego Garcia from ICE Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The court challenge center on conflicting claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
